Introspection and Retrospection


  1.      Plans are made with an objective and such plans get executed in  given environs.  When executions are carried out  actions are performed which ultimately produce results.  After the occurrence of such an event usually everyone is expected to introspect about the actions performed vis-a-vis the result arrived in various dimensions and certain conclusions are arrived at with a futurist outlook.  If the actions are good and equally the results also an outlook for betterment may be thought of.  On the other hand, if actions; performed did not yield expected results a vision may be developed for prospective corrective actions.  Hence, introspection is to be understood as an act of directly observing the process of one's own mind with reference to an act performed presently or in the near past thus carrying out a self-examination..

          'Retrospection' on the other hand, means 'to look back' or ' to contemplate of the past'.  This exercise is usually done with reference to 'too good things happened' or 'too bad things happened' in one's past.  But retrospection may merely stop with the reflection of the past and an intent to apply the said result of retrospection may or may not be present.  In fact, in certain spheres of activity certain decisions taken after retrospection may be capable of putting into prospective operation in a facile manner while in certain cases such operation may not be feasible..  In the latter types of situations one has to reconcile with the past.  This, however, does not mean that retrospection should not at all be made since retrospection is also a form of introspection..

     The two precepts made out above, considering their nature, belong to the genre of psychic element (mental exercise) and require practical application in a given situation.   .

Assent and Assertion

     Decisions are to be made at various stages in life and in every walk of life.  The decision maker may be any person - a manager, an executive or even an assistant who may have to complete the job assigned and transmit the same to the next higher  level for further action.  Therefore, the decision maker has to declare his intent in such an affirmative manner so that such decision when ultimately takes shape it may enable other persons who may be bound by such decision to give his assent without any demur.  This will incidentally enable the person who has given his assent to the decision taken may not have any regrets in future..  After all, assertions are being statements made from the thoughts flowing out of the discretionary faculty and such decisions are to be adhered to steadfastly right from inception  stage.  Otherwise any statement made will not lead to proper assent. In fact, assertions lead to 'certainty and that kind of certainty should be the hall mark in any decision making process. Statements, when made, should not be sports of an idle hour nor mere matters of pleasantry nor badinage never intended by the persons to create a tie or bond. Hence, casual statements or statements which are unproductive may not be called as 'assertions'.  Assertion is a fore runner to any assent that has to be given.  These two precepts, therefore, hinge on the mind set of the decision maker for which preparatory measures are to be worked out with foresight..

Semantics of Stratagem and Strategy

         The captioned precepts assume significance whenever an action is proposed to be launched.  Though these two precepts cited ostensibly appear to be one and the same a bit of  delving reveals that 'Stratagem' remains to be a principle and  that  'Strategy' refers to the modus operandi contrived to carry out that principle.  This means that 'Stratagem' is substantive in nature while 'Strategy' is  one of procedure.  'Stratagem' denotes a plan, a device, a trick with other variations while 'Strategy' is referred to as tactics, a system or an approach towards the execution of the stratagem chosen.  For all practical purposes,  it may be said that both stratagem and strategy should be kept as a guarded secret till the act is accomplished.  However, in some cases, the stratagem may be revealed but the strategy should not any account be disclosed till the action becomes a fait accompli.. VIDHURA NEETI also lends support to this view in the sense that a wise man's plan should not be divulged till it is carried out.  After all, before doing every action a plan is drawn with an objective and commensurate to it a strategy is to be worked out to fulfill the said objective.  If either the stratagem or the strategy delineated will not lead to any desired destination it would be futile to embark upon such an exercise.  Hence the semantics of the two precepts outlined must serve as an eye opener for all young entrepreneurs and for all those who may be called upon to perform tasks involving planning and execution...     .

Justness and Adjustment

     The terms found in the caption occupy my mind whenever I hear a grievance from a person or when myself find that actions performed are not going in the desired direction.  When the causes for this state of affairs are analysed it only comes to light that the precepts of 'Justness' and 'Adjustment' have not been accepted, adopted and adapted.  The precept 'Justness' denotes fairness and righteousness among other denotations.  Likewise the precept 'Adjustment' calls for a 'regulation';  or an 'arrangement' to be made.  These two precepts, therefore, stand in juxtaposition since it is only then the action performed would not only be welcomed as an  upright measure but also would not cause 'hurt' to others who may also be associated with the performance of that action. Any deviation in the manner of application of these precepts  by any person would only be viewed as an action performed only to obtain sadist pleasure by the person who called for the performance of such action  Is it not better to follow these precepts when a team effort is called for in an organisation?  It is, therefore, essential that fairness in dealing with the workforce coupled with the regulation to exact work in terms of the portfolio assigned should be adopted.  After all, implicit in 'fairness' and 'regulation' one can also find the time limit and any manner of hastening the process of the desired work may not give the desired result.  Therefore, in any action,  these precepts of 'Justness' and 'Adjustment' are to be pursued to the true letter and spirit and practice in this regard is to be inculcated in the minds of the  persons responsible calling for the shots.  .

Relationship between Accountability and Obligations

     I have chosen the cited caption for today's blog as in the present day the term 'Accountability' is talked about very often and especially when a wrong has been detected.  But the reality that exists is that. accountability does not arise only after the detection of the wrong but commences right from the conception to do an act.  This is obvious from the semantics of the term 'accountability' which only points out that it is 'a responsibility to fulfill one's obligation.  Moreover, the term 'obligation' points out that it consists of rights to be exercised and duties to be performed and in that course acceptance of liabilities, if any, that may arise.  Therefore, accountability is implicit once a relationship gets established . It will, therefore, be a misconception if it is understood to arise only after the wrongs have been detected.  Rights and duties arising out of any relationship are correlative and it creates a binding effect on the parties.  This sense of proportion is to be borne in my mind as it is only then the performance of rights and duties by the respective parties in the relationship will go in the right direction and which may even help in the avoidance of the commission of wrongs as well.  Above all, it is the 'Obligation' which grants the power to perform the rights and duties and as a consequence accountability also follows.  In fact, it is not for every feasance (doing an act) accountability will be called for so long as as the said feasance is intravires,  while accountability, as is normally understood in terms of fiduciary liability, will be called for only for misfeasance (doing a lawful act in a wrongful way) or for  malfeasance (doing an illegal act or an act being positively unlawful) or on certain occasions for nonfeasance (omission to do an act) with which one is vested. It would, therefore, be fit and proper to understand the precept of accountability from the inception of the relationship itself. rather than taking defenses.when accountability is sought to be fastened...  ..

Essentiality of harness

     In general parlance the  term 'harness' denotes an equipment required for a task  Possession of an equipment,therefore, becomes essential and the choice of choosing an equipment is consequentially left in the hands of the performer of the task. Hence, equipment may vary from person to person.  But mere possession of equipment alone may not suffice unless the chosen equipment is one befitting the purpose for which it is intended.  The equipment referred to  is not confined  only to tools and implements in the real sense of the term, but also includes mental equipment in cases where such a an equipment is a sine  quo nom. In this circumstance the mental equipment must also be functioning naturally and normally so that the given task on hand is accomplished in the desired manner.  One factor which may impede the mental  equipment to give its real output is its working beyond the optimum limit.  Therefore, care should be taken to avoid granting over work to the mental equipment.  In the present day I find persons working as night owls tend to  forget that the mental harness, given as a gift by the Omnipotent, is meant to be preserved throughout the life span of a person. It is, therefore, essential  that harness required in any form is to be preserved, if it is feasible to do so, and such preservation is to be observed as a precept so that the harness so preserved will serve as a  better equipment for the next day.  .

Res Gestae in life cycle

     This caption has been derived from Latin language, which as an academic in Law, was  used  especially while teaching Law of Evidence to the student community..  The significance of this term is pointed out as  'forming part of the same transaction' .  This term, being a rule of evidence, is used to find out the 'cause and effect' of the transaction  In fact, but for the application of this term the decision may go haywire and the reality cannot be got fixed.  Such being the import of this term, the semantics of this is also applicable to one's life cycle also. It may be directly said at this stage  that our human system  is no exception to this phenomenon.  In every person's life, for every action done there will be a prime cause and an effect following the same although many other causes and  many other effects following.. While deciding a case on hand the prime cause is  taken into account. and at the same time  all other causes following the same will also be considered in order to  pinpoint the ultimate effects..  While doing so this precept of Res Gestae is adhered to which will serve as an eye opener for the deciding authority  This principle applies to the same degree  and in the same vein to every action performed by a person in his life cycle and no human is an exception to this.  Hence it is always better to perform actions in such a manner that there will be coherence between the act done and the effect arising out of the same which alone fulfills the desired desire.....  .  .   .,

Feats 'On the Chair' & 'Off the Chair'.

     I was thrilled to note that I was able  to complete Blogs in the single digit order and entering the double digit figure though I started writing blogs at a little late stage.  Ever since this fulfilment I have been ruminating about a precept which was occupying my mind and which in my view was one of the causes for the arisal of the dissatisfaction to many and hence chosen a caption for today's blog..

     Every person is endowed with a personality of his own and a shade of personality based on his status.  When this person performs actions the same is tested to find out the exact outcome and its consequences.  This exercise is being done since outcome of any action willl only reveal the mind set of such person with reference to such an  outcome.  This exercise would, therefore, reveal from which Chair the outcome has come.  If the outcome is based  'On the Chair' it would point out the power and authority associated with Chair and consequentially a relevant mindset having been framed for that purpose.  This attitude cannot be said to be meaningless since every person occupying a status has to wield some power and authority commensurate to his status.  But the question is whether the same degree of exercise of power and authority  be also carried forward to an action 'Off the chair'..  The answer is obvious in the sense that the same degree of exercise should not be adopted.  The reason is that for every action 'Off the Chair', not only the action and its outcome will be different and that a different  mind set is required for this purpose.  For instance a teacher in a class-room is a different personality and his status at home is a different one.  This analogy holds good for every person.  In other words, though it is the same individual who would be the doer of actions it is but advisable that every person takes care to see that his actions are not the same and only suited to the purpose since it is only then one would be able to understand that the personality in one sphere does not clash with the other..  The adoption of this precept and practice therefor will be a panecea for surmounting all the obstacles and difficullties and hence ,balancing the Chair' is a must. .   ..

Pragmatic endeavors

     It is since a month I sat to continue  to write my blog and this respite had been occasioned due to my involvement in adhering to certain religious precepts and  practices.  However,  this respite had given me time to  do some introspection on the values inculcated by my father who laid down his life at the ripe age of 96 and hence  I have started  today my action  to write blogs  on the values which have been  imbibed by me.from him.  Infact today's blog  forms part of one such values.

     I endeavor to write on Precepts and Practices only to highlight the cause for which various Precepts have been carved out and how best such precepts are to be practised.  Endeavor cannotes effort or undertaking and hence  when a person has chosen an endevor he should not resile from the same for flimsy reasons unless it reveals that pursuance of such an endeavor is harmful in some way or the other.  It, therefore, becomes a must for every person to keep endeavoring on some mission or other which suits his interests best.  Hence procrastination of such an endevor is not in good taste.  Though one may endevor,.it should not be forgoteen that pragmatic endevor would yield best results.  This means that endeavor made with practicals and practicability in mind would lead to sustained progress and development.      .  .

Planning and Execution

Planning and execution are two facets of an activity in any enterprise or in any of the actions that may be performed at any point of time. Planning is ,therefore, a thought process prior to embarking in an activity and execution of that plan follows suit,  So, plan as a device is to be thought of carefully based on the goal desired to be achieved and to do so a foresight vision should also be developed.  If the thought processes do not proceed in this desired direction the end result  may not be a satisfying one.  Hence any plan should envisage an object, a time frame,a subject matter capable of  easy comprehension ,  a built-in methodology and last but not  least  a goal to be reached.  The planners should therefore possess the expertise required in this regard and if not the expertise is to be hired.  Planning, therefore, forms an integral part of any system
     After planning is made, execution follows suit. and such execution is to be carried out to the true letter and spirit of such plans  so that the desired end may be achieved.  .  Even while carrying out  execution of the plans  problems may be encountered and such problems are to be met with and resolved to achieve the goal set out in the plan.  Execution of a plan must also be time oriented and must also be a  practicable one as otherwise the plan made will be a meaningless one.   Also execution  that may be done must always be within the set parameters for that purpose as execution would have to be done in varying degrees dependent on the plans made.
     Planning, therefore, remains a precept while execution of the plan set calls for the adoption of a practice in that regard..

Basis of Attitude

     When I sat today to write this blog my mind was working only to find a way out either to overcome the  failures that may arise or to meet the failures and then  to find a way out for the recurrences of the same.  As I was pondering over this through out this day one  factor that cropped up  in my mind was that  either for the act of overcoming the failures prior to their occurrence or to meet if occurred revolves around the  presence of 'attitudes' that lie within us.  I have been,therefore, necessitated to scan through the literature in this regard.  I could only find attitude and its various variants have been highlighted and  heterogeneous ways suggested to adopt various attitudes.  'Attitude' after all encompasses an inclination, nature,temperament,mood,viewpoint etc  These compositions of the attitude emanate only from the compos mentis possessed by a person.  I t could,  therefore,  be emphasised that a mind set is to be drawn up before the adoption of a particular attitude which but lies in the hands of that particular person. It  is my considered view that if  the required  mindset has been 'set' it woud be but easy to overcome the failures or prevent their recurrences. Therefore 'Attitude' as a precept remains for all times to come while the application and enforcement of the attitude lies in the personsality concerned and practice in this regard becomes sine quo nom..     .

Basics of ,Law,

     ,Law, in common parlance connotes , a rule or regulation intended to establish an order in a society..  The corresponding term used in Latin is LEX  The significance of this meaning can be better understood by posing a question viz., . whether one would like to drive safely as per the traffic rules or otherwise.  The answer is obvious.
   All countries in the world have for themselves a Constitution, being the primary law of that land, which not only provides the manner in which the political system of that country will be drawn but also provides for  'making of other laws' to meet the needs of the people.  The primary law is available as a TEXT OF THE CONSTITUTION while the other 'Laws' would be called as Law, enactment   Statute,or Act.  In otherwords, Other laws would be enacted based on the primary Law  and hence Other laws should not be ultravires the primary law  Other laws would be variants in nature since the subject matter for each law would also vary and each such law  would have been made with a purpose based on expediencies.  Hence  if a dispute or difference arises on a subject matter the relevant law is to be taken recourse to and the  rights and duties set out  in that  law would find its application.  It is only in this context the Courts of Law apply the particular law and hands out Judgments, of course ,based on the nature and circumstances of the case.  It may be pointed out at this juncture that the decions given by the Superior courts of Law would create a binding effect on all  the  courts below it.  Such binding decisions also become Law,  known as Judge-made Law although in the stricter sense of the term Courts of Law cannot make a 'Law' since such duty will be cast on the Parliament or the Legislature by the primary Law. Whatever name by whcih a Law may be called, obedience to law is essential for the establishment of good society. Therefore, Law as a precept will be available in every country in various dimensions and the obedience  or the breach thereof lies in the practice of the society at large.

Desire to work - Hard work Vs Devoted work

     Every person in his quest  for survival desires to be engaged in one activity or another.  In doing this exercise it is not the quest alone that matters but also an attitude to get befitted into the work with all volition.to derive satisfaction to the maximum degree. This principle is seldom followed since thoughts over  material gains are given preference over the aptitudinal aspects towards the work chosen.  As a result one lands in a work spot and tries to put in hardwork and gets exhausted besides himself also not achieving any satsfaction..It is to  be understood in this context that the management may also not favour him in the long run as he may be considered to be an extra burden.especially when the same output may be obtained in a much more easy fashion from the hands of a devoted worker. The case would be otherwise if the hard work done also turns out to be a devoted work with a heavy output..  But these types of persons would form part of a rare breed.  On the other hand, if a person chooses an activity commensurate with his aptitude he will turn out to be a devoted worker, thus satifying himself and also the management to which he belongs. Moreover the turn out from a devoted worker will be on the high side and that end would also havebeen achieved in a facile manner.when compared to a person who would have put in hardwork. In other words the principle to do a 'work'  remains authenticated for all times to come but the aptitudinal aspects towards work deserve  consideration depending on the nature of work.

Acknowledgment of realities

   'Acknowledgment'  in common parlance connotes acceptance,affirmation,corroboration, recognition and as such this concept  stands as a testimony to the  acts and actions performed.  This concept,therefore, finds its way in every one's  life by some means or other at  various points of time.  As a consequence this concept is to be adopted,accepted and adapted by everyone and through such means any relationship may not only be fostered but also strengthened for a lasting life. Contrarily, if this concept is not pursued it is bound to boomerang to unexpected destinations.  More than  this, acknowledgment of the realities of life assume significance.  Realities in life may be said to fall under the theory of cause and effect; but many forget this as the  base which in turn jettison them. in unwanted directions.  This attitude needs correction and this can happen only when the mind set is focused towards the realities of life. Why this failure arises can be deciphered only when introspection is made and not otherwise. Many of my students asked me the question as to whether compensation awarded  to the relatives of an accident victim would suffice the purpose when a life itself is lost.    My answer to them was that the realities of life should not be forgotten explaining thereby that the deceased victim cannot be brought back by any means or by any person and that the only way out is to' place the relatives of the victim in a status as far as money could do' and thus  this way of approach remains in Law as a principle by itself. Although this one instance is cited to drive home the point that realities of life are to be understood it should not be construed  that that realities are to be understood only with reference to the cessation of life.  Even while being alive when acts are performed in a wrong way acknowledgement of the wrongs would pave way for correction and one should,therefore, endeavor.to create a mind set for himself towards this end and hence practice is to be made in this direction right from one's early life. The concept of 'Acknowledgement',therefore remains static and putting this concept into practice requires serious consideration and this means will turn bring forth peace and happiness for which alone we all strive to exist.. .

Semantics of Communication

Communication - creates links, establishes and fosters  the relationships,enables liaison with the people in all walks of life,enables understanding of people, ,imparts  invaluable values, brings out the character of the personalities etc,So far so good. especially when actual communication takes place - be it verbal or through any other mode.  In general, communication takes place with all enthusiasm and fervor. when  one's mindset is attuned for the same and this results in reciprocity from the other end. This trend gives maximum happiness to maximum number.But the other aspect of non-communication deserves consideration. Contrarily  non-communication distances people,produces sour relationships, creates embarrassing situations and at times lead to cessation of relationships.  Reasons are not far to seek.  In these situations one has to do lot of introspection based on his own mental state - past and present as well - shedding one's ego and endeavor to diffuse the situation by effective means of communication. This approach from my end may appear to be embarrassing for a person, which in fact would happen. After all one who has consumed salt has to drink water to overcome the poisons produced by salt. If this practice is not practiced non communication may even lead one to gorgeous depth. It would,there be fitting to say that the precept of communication is static while the practice or non-practice of it is left to the mind set of a person and hence a variable phenomenon.   

To Be or Not To Be

I write this maiden blog after about 23 hours of initiation.When I was pondering over a caption  I was reminded of the Shakespearean question and  hence thoughts flow on these lines.

     Every person in his life has to face situations - expected or unexpected and at these times difficulties crop up to take a decisive decision and invariably he or she lands in a confounded state. At these times the captioned question may come to one's rescue. Though one may wonder as to how the application of this question is vital as regards expected situations.it may be said that he or she would have reached the situation but would not have thought about the consequences ensuing from the same.Under these circumstances if one makes up his mind and comprehends the situation in all dimensions  it would give the desired result followed by achievement and satisfaction.This principle applies on all force to meet unexpected situations.The need of the hour would definitely fill the gap yearned for before. The precept of following a command and obeying that command with ingenuity in order to meet a situation are steps to be pursued to be a 'complete man'  which which will in turn enhance one's internal and external personality.. Practice in this regard,therefore, becomes a must.since practice is but  procedural in nature while precepts are substantive  in nature.

Prologue for Precepts and Practices

I have chosen to enter the goup of bloggers  after realising that the thoughts entertained by me and practised in my life may be of some value addition to me by way of rumination and by way of creating an interest to the readers.
       As a person born in the year in which India obtained Independence I could be notr called a new man in the real sense of the term since my parents being prior 'independence' persons have inculcated certain values in me which I have followed and still following. Considering this status of mine  the precepts and practices learnt are at times found to be conflicting with the modern times. I have,therefore, determined to analyse the causes and effects of thisconflicting considerations in my ensuing blogs basing the analysis on my career as a law teacher for 3 decades and on my experience gained by interacting with various persons.
